IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE.
1. INTRODUCTION
1.1. These terms and conditions (the "Terms") govern your relationship with Selby Amateur Boxing Club C.I.C. (the "Club"). By enrolling in our programmes or using our facilities, you agree to abide by these Terms. Please read these Terms carefully. If you do not agree to any part of these Terms, kindly refrain from participating in our activities.
2. MEMBERSHIP
2.1. To become a member of Selby Amateur Boxing Club, you must complete the Club's registration process, provide accurate information, and pay the applicable membership fees. The joining fee is non-refundable.
2.2. Members of adult classes must be 18 years of age or over. Individuals under the age of 18 may only take part in the age-appropriate sessions and must have the consent of a parent or guardian.
2.3. Membership is personal and non-transferable. You may not share your membership or grant access to our facilities or programmes to another person.
2.4. To be covered under the England Boxing insurance arrangements, amateur boxer participants must be registered with England Boxing. It is your responsibility to ensure your registration is completed and kept up to date.
2.5. The Club reserves the right to refuse or revoke membership at its discretion.
3. HEALTH COMMITMENT STATEMENT
3.1. By becoming a member, you acknowledge and agree that participating in boxing and fitness activities may involve risks to your health. You are responsible for ensuring that you are in good health and suitable physical condition to engage in these activities.
3.2. It is advisable to consult a healthcare professional before starting any fitness programme. If you have any underlying medical conditions, you must ensure that your participation in Club activities will not adversely affect your health.
3.3. While the Club is committed to providing a safe and controlled environment, you accept the inherent risks associated with boxing and fitness activities, as set out in clause 6.
4. CANCELLATION POLICY
4.1. Membership Cancellation:
4.1.1. Members may cancel their membership by providing written notice to the Club. The notice period required for membership cancellation is 30 days. No refunds will be provided for any unused portion of membership fees, and the joining fee is non-refundable.
4.2. Class and Session Cancellation:
4.2.1. The Club reserves the right to cancel or reschedule classes or sessions as needed and will make reasonable efforts to inform members of any changes.
5. CONDUCT AND SAFETY
5.1. Members must adhere to the Club's rules, guidelines and the instructions provided by our coaches and staff.
5.2. Respect for other members and staff is paramount. Any behaviour deemed disruptive or disrespectful may result in membership suspension or revocation.
5.3. Members must ensure proper attire and equipment are used during training and must follow all safety instructions diligently.
6. LIABILITY AND INDEMNIFICATION
Sparring, Ring Work and Competition
Participation in sparring, ring work and competitive boxing is restricted. Before taking part in any sparring, ring work or competition, you must:
(a) be a current, registered member of England Boxing; and
(b) have completed and passed the required medical assessment.
Participants who are not registered with England Boxing, or who do not hold a current valid medical, may take part only in the non-contact training elements of our sessions (for example, fitness, technique, pad work and bag work) and must not take part in any sparring, ring work or competition.
This is because boxing is covered under the Club's insurance as part of a training regime only. Sparring, ring work and competition are covered separately through England Boxing membership for registered members. The Club reserves the right to refuse participation in sparring, ring work or competition to anyone who does not meet these requirements.
6.1. Inherent risk of the sport. Boxing and fitness training involve physical exertion and, in the case of sparring and bouts, physical contact. These activities carry an inherent risk of injury that cannot be entirely removed. By taking part, you accept the ordinary and standard risks that are a normal part of the sport, including standard in-sport injuries sustained during training, sparring or bouts that do not result from any failure of care by the Club.
6.2. The Club's duty of care. The Club remains responsible for taking reasonable care for the safety of participants and for maintaining a reasonably safe environment, equipment and supervision. Nothing in these Terms excludes or limits the Club's liability for death or personal injury caused by the Club's negligence, or for any other liability that cannot lawfully be excluded or limited under the laws of England and Wales.
6.3. Personal property. The Club is not liable for loss of or damage to a participant's or guest's personal property brought onto the premises, except to the extent that such loss or damage is caused by the Club's negligence.
6.4. Club insurance. The Club maintains its main insurance policies as required for its activities.
6.5. England Boxing cover. Members who are registered with England Boxing also benefit from the personal accident cover provided through England Boxing membership. This cover is provided on a no-fault basis but is subject to limits and is not designed to replace lost income. Full details are available from England Boxing, and you are encouraged to review them.
6.6. Your own insurance. Provided the Club maintains its main insurance policies, members and clients are responsible for arranging any additional personal accident, medical or income protection insurance they may wish to hold. The Club strongly recommends that participants consider arranging their own cover, particularly where they rely on income that could be affected by injury.
6.7. Reporting accidents. All activities are undertaken at the participant's or guest's own risk, subject to clauses 6.1 and 6.2. Any participant or guest who suffers an accident or injury on the premises must report the accident or injury, and the circumstances in which it occurred, to a member of the coaching team as soon as possible so that it can be recorded.
7. PRIVACY AND DATA PROTECTION
7.1. The Club will collect and use your personal information as described in our Privacy Policy.
8. AMENDMENTS TO TERMS AND CONDITIONS
8.1. The Club may update these Terms from time to time. We will notify members of any significant changes, and you are responsible for reviewing the updated Terms.
9. GOVERNING LAW
9.1. The laws of England and Wales govern these Terms, and any disputes will be subject to the exclusive jurisdiction of the English courts.
By becoming a member of Selby Amateur Boxing Club, you confirm that you have read, understood and agree to abide by these Terms and Conditions. If you have any questions or concerns, please contact us before proceeding.
10. INTELLECTUAL PROPERTY
10.1. We are the owner or the licensee of all intellectual property rights in this Website and in the material published on it. Copyright laws and treaties around the world protect those works. All such rights are reserved. The design and layout of this Website are protected by copyright, database right, design rights and other similar laws and may not be copied or imitated in whole or in part.
10.2. The trademarks, logos and trade names displayed on the Website ("Marks") are the property of Selby Amateur Boxing Club or other third parties. You are not permitted to download, copy, modify or use the Marks without our prior written consent or the consent of such third party who may own the Marks.
10.3. We and our suppliers own the intellectual property rights in the software that runs this Website. Save to the extent expressly permitted by applicable laws, you must not copy, modify, download, distribute, decipher, decompile, interfere with or attempt to interfere with that software without our prior written consent.
11. YOUR USERNAME AND PASSWORD
11.1. Certain areas of our Website are restricted and may only be accessed if you are registered with us and have been issued with, or have chosen, a username and password.
11.2. You must not allow any other person to use your username, password or other login details and must treat such information as confidential and must not disclose it to any third party. If you believe someone else knows your login details, you must contact us at info@selbyboxingclub.co.uk or manager@selbyboxingclub.co.uk as soon as possible.
11.3. We reserve the right to disable any user identification code or password used to access this Website at any time if, in our reasonable opinion, you have failed to comply with these Terms.
11.4. You shall not obtain or attempt to obtain unauthorised access to any area of this Website which is only accessible with a username and password other than that which has been identified as being available to you, and you will not attempt to evade our authentication or security procedures, nor assist, encourage or permit any other person to do any of the above.
11.5. You should be aware that some of the documents, files and other information may contain personal data subject to applicable data protection legislation. You must not use that data contrary to such legislation.
11.6. We shall not be liable for any losses you suffer as a result of unauthorised access to your account until you have informed us of unauthorised use, or possible unauthorised use, of your login details or of a breach of security at info@selbyboxingclub.co.uk or manager@selbyboxingclub.co.uk.
11.7. If you are accessing an area of our Website protected by a username and password to use the Services available through it otherwise than in the course of your business, you have certain statutory rights as a consumer regarding the performance of Services. These statutory rights will not be affected by any statement contained in these Terms.
